Texas State Continuation of Coverage
For groups subject to COBRA, Texas law allows an additional six (6) months of coverage after COBRA ends. The law applies only to fully insured groups. COBRA participants are eligible for the additional six (6) months of continuation coverage after 18, 29, or 36 months of COBRA coverage.
If you administer COBRA for your group, provide COBRA continuants approaching the end of their 18, 29, or 36 month coverage with a Texas Six (6) Month State Continuation of Insurance Application Form . When application is made within 30 days of the date COBRA ends, coverage and premium payment will continue without interruption for an additional six (6) months.
You must cancel the continuant's coverage online through Blue Access for Employers® or notify BCBSTX in writing at the end of the six (6)-month continuation coverage period, or within 30 days of any of the following events:
- You discontinue offering your group health plan to all employees
- The continuant fails to submit a premium payment within 30 days of the due date
- BCBSTX receives notification from you or the continuant that the continuant has obtained other group coverage
- BCBSTX receives notice from you or the continuant that the continuant has become eligible for Medicare coverage
- The continuant requests to drop coverage
If BCBSTX is your COBRA Services administrator, direct the employee to call 1-888-541-7107 to request an application for the continued coverage.
If a Third Party Administrator (TPA) administers your COBRA, please contact your TPA.
